These Terms of Service ("Terms") are a legal agreement between you and AgilityFinder (the "Company", "we", "us"). By using our services, you agree to these Terms.
Our Services include:
- AgilityFinder User App: FREE forever for dog owners to find clubs and classes
- ClubManager App: Professional tools for clubs and instructors to manage their business
- Our website at https://agilityfinder.com
Important: If you don't agree with these Terms, please don't use our Services. Using our Services means you accept these Terms and our Privacy Policy.
2. What We Offer
For Dog Owners (Free)
The AgilityFinder User App is completely free and includes:
- Finding agility clubs near you
- Browsing and enrolling in classes
- Managing your profile and your dogs' profiles
- Tracking training progress
- Connecting with the agility community
For Clubs and Instructors (ClubManager)
Professional management tools including:
- Class and facility management
- Member enrollment and registration
- Schedule and capacity planning
- Payment processing
- Communication with members
- Performance analytics
3. Age Requirements and Account Setup
Who Can Use Our Services
- Minimum age: 13 years old
- ClubManager: Must be 18+ to manage a club
- Teens (13-17): Need parent permission
- Under 13: Sorry, our Services aren't available for children under 13
Creating Your Account
When you sign up, please provide:
- Accurate information about yourself
- A valid email address
- A secure password
You're responsible for:
- Keeping your password safe
- Everything that happens with your account
- Telling us immediately if someone uses your account without permission
4. Data Sharing When You Join Clubs
What Happens When You Apply to a Club
When you apply to join a club or enroll in classes, you agree to share certain information with that specific club:
Information We Share
- Your details: Name, email, phone number, WhatsApp (if provided)
- Dog information: Breed, age, experience level, medical info (if you choose to share)
- Photos: Your profile picture and dog photos (if uploaded)
- Emergency contact: For safety during training
- Training history: Previous classes and experience
Why We Share This
Clubs need this information to:
- Process your membership
- Enroll you in classes
- Contact you about training
- Keep everyone safe during sessions
- Maintain their records
Your Control
- We only share with clubs you choose to join
- You can update your information anytime
- You can ask clubs to delete your data
Club Obligations
Clubs must:
- Use your data only for club activities
- Keep your information secure
- Follow data protection laws (like GDPR)
- Not share your data without your permission
- Delete your data when you ask
5. Pricing and Subscriptions
Free Forever: AgilityFinder User App
The User App is completely free for all dog owners and agility practitioners. No hidden fees, no surprises.

60-Day Free Trial
- Try any ClubManager plan free for 60 days
- No payment required during trial
- Cancel anytime without charges
- Automatically converts to paid plan after 60 days unless cancelled
How Billing Works
- Automatic renewal: Plans renew automatically each period
- Payment method: Credit/debit cards via Stripe
- Price changes: We'll notify you 30 days before any price increase
- Failed payments: 7-day grace period to fix payment issues
Price Changes
We reserve the right to modify our pricing at any time. Here's how it works:
- Advance notice: We'll notify you by email at least 30 days before any price increase
- Your options: You can cancel your subscription before the new pricing takes effect
- Acceptance: Continuing to use ClubManager after the effective date means you accept the new pricing
- Annual plans: If you're on an annual plan, price changes only apply at renewal
- Grandfathering: We may offer existing customers special rates, but this is at our discretion
Note: Price decreases may be applied immediately without notice. The free tier will always remain free for the features it currently includes.
Changing Your Plan
- Upgrade: Takes effect immediately with prorated charges
- Downgrade: Takes effect at next renewal
- Cancel: Keeps current plan until renewal date, then moves to free plan
What Happens If You Don't Renew
- After 7 days: Classes exceeding free plan limits are automatically cancelled
- Your data remains available for 30 days for export
- You can reactivate anytime by choosing a new plan
6. No Refund Policy
We don't offer refunds because:
- You get a generous 60-day free trial to test everything
- You can cancel anytime during the trial without any charges
- You're never charged without first trying the service
Exceptions: We may consider refunds only for:
- Billing errors or unauthorized charges
- Extended service outages caused by us
- Other exceptional circumstances at our discretion

7. Affiliate Program

How It Works
- Tracking: 30-day cookie duration via Affonso.io
- Attribution: Last touch model
- Hold period: 30 days before commission release
- Minimum payout: €75
- Payment methods: PayPal (international) or bank transfer (Spain)
- Invoice required: Valid invoice in EUR for Spanish tax compliance
Commission Examples
- Ambassador referring Championship monthly: €29.99 × 40% = €11.99/month
- Affiliate referring Pro annual: €164.04 × 20% = €32.81 one-time
Important Notes
- Commissions apply to all payments for 12 months from initial referral
- Commissions adjust if customer changes plans
- Discount coupons only work once per customer
- Coupons expire if affiliate relationship ends
8. Content and Intellectual Property
Your Content
You keep ownership of everything you upload (photos, videos, text). By sharing content, you give us permission to:
- Display it in our Services
- Help clubs and users connect
- Improve our Services
- Promote our platform (with your consent)
You can delete your content anytime, and we'll remove it promptly (though backups may exist for up to 90 days).
Our Content
AgilityFinder's platform, features, and design belong to us and are protected by copyright and trademark laws. You can use our Services but can't copy, modify, or resell them.
9. Rules for Using Our Services
Please Don't:
- Use our Services for anything illegal
- Harass, bully, or discriminate against others
- Share false or misleading information
- Try to hack or disrupt our Services
- Create multiple accounts to avoid bans
- Post inappropriate content
- Share others' personal information without permission
- Use automated bots or scripts
We May:
- Remove content that violates these Terms
- Suspend or terminate accounts that break rules
- Report illegal activities to authorities
- Take legal action when necessary
10. Privacy and Data Protection
Your privacy matters to us. We follow GDPR and other data protection laws. Key points:
- We only collect necessary information
- We get your consent when required
- You can access, correct, or delete your data
- We protect data transfers outside the EU

11. Service Availability
- We aim for 99.9% uptime but can't guarantee it
- Scheduled maintenance may cause brief interruptions
- We're not responsible for outages beyond our control
- Some features may not be available everywhere
12. Liability Limitations
To the extent allowed by law:
- Our Services are provided "as is"
- We don't guarantee uninterrupted or error-free service
- We're not responsible for other users' actions
- Our maximum liability is limited to what you paid us in the past 12 months or €1,000, whichever is less
- We're not liable for indirect damages or lost profits
These limitations don't apply to:
- Death or injury from our negligence
- Fraud
- Gross negligence or intentional misconduct
- Anything we can't legally limit
13. Indemnification
You agree to protect AgilityFinder from claims or costs arising from:
- Your use of our Services
- Breaking these Terms
- Violating others' rights
- Your content
- Any fraudulent or illegal activities
14. Ending Your Account
You Can Leave Anytime
- Cancel through your account settings
- No refunds (remember the 60-day free trial)
- You're responsible for charges before cancellation
We May Suspend or Terminate If You:
- Violate these Terms
- Don't pay your fees
- Engage in fraud or illegal activities
- Abuse our Services or other users
15. Disputes and Legal Stuff
- Governing law: Spanish law applies
- Courts: Disputes go to Valencia, Spain courts
- EU consumers: Your statutory rights are protected

- If part of these Terms is invalid, the rest still applies

- Not enforcing a rule doesn't mean we give it up
- English version prevails if translated
